Important information to our CN Unifor Membership in the Greater Toronto Area

On October 3, 2013, CN issued notice pursuant to Article 8.1(a) of the Employment Security and Income Maintenance Agreement (ESIMA) advising that they were centralizing their accounting activities into one centre at their headquarters location in Montreal.
This change will see 31 members who are presently employed at the Revenue Management Centre in Mississauga, Ontario adversely affected and the loss of 31 permanent Unifor Local 4003 positions in the Greater Toronto Terminal. This change will be done in two phases, the first - 11 positions - effective February 28, 2014, and the second and final phase - 20 positions - will be effective January 5, 2015. These changes will cause subsequent displacements that will adversely affect other members in the Greater Toronto Area (GTA).
The Company has already moved some positions last year and in 2012 to Montreal, whereas the Union negotiated various items to protect members in the GTA, including relocation benefits to Montreal for those members that chose to relocate with full seniority, and ensured the Company offered training to existing members in Montreal and hired new members to fill whatever vacant permanent positions existed after transferring the work from Mississauga.
The Union and Company have held several meetings and conference calls to reach an agreement pursuant the terms of Article 8.4 of the ESIMA. Article 8.4 permits the parties to negotiate on items other than those specifically dealt with in the ESIMA with a view to further minimizing the adverse effects on members.
Last week, we finalized an agreement that includes the following items:

A sign-up (paper displacement process) is commencing this week. Members will be notified by telephone at which time they will be provided with relative information concerning their displacement, where the Company deems them qualified, where they may be eligible to train and what permanent positions their seniority will permit them to hold. Articles 13.3 and 13.4 of Collective Agreement 5.1 will be applicable from the time a member is advised.

Last week, we finalized an agreement that includes the following items:
- Lump sum relocation benefits as set out in the ESIMA for members with Employment Security (ES) protection and/or ESIMA Article 6 Relocation Benefits with an enhanced extra week pay for time to relocate (14-days total - two weeks actual pay). Article 6 benefits will be provided to members without ES (hired prior to January 1, 1994), but whom have two years cumulative compensated service (CCS) with the Company;
- Training opportunities at Crew Management Centre, Transportation Reporting Services, administrative positions at Mac Yard and at CN Intermodal operations in the GTA;
- Special retirement incentives to members who are eligible for early retirement under the CN Pension Plan rules.
